Your Status

By placing an order through our site, you warrant that you are legally capable of entering into binding contracts and you are at least 18 years old. We will not provide services to anyone who is, or appears to be, under the age of 18. We reserve the right not to deliver if we are unsure of this.

How the contract is formed between you and us

After placing a request, you will receive an e-mail from us acknowledging that we have received your request. Please note that this does not mean that your request has been accepted. Your request constitutes an offer to us to ask about a Service. All requests are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that your request has been approved. The contract between us will only be formed when we send you the confirmation. We reserve the right to refuse any order or cancel a request at any time without giving a reason.

Please note that once you have made your request and your payment has been authorized you will not be able to cancel your request and that refunds may be given at the discretion of the management.

Our Status

We are entering into the Contract ourselves and not as nominee or agent for any other person and we alone shall be responsible to you under it; no other person, as agent or otherwise, is entitled or authorised to bind or commit the Company to any obligation to you.

Availability and Delivery

Your service will be provided at time and date set out in the confirmation. Service will be provided at verified addresses or nearby common place by the consent of both service provider and receiver. Service delivery periods quoted at the time of requesting are approximate only and may vary. Service will be provided at the address designated by you at the time of request. You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of request. In case of a late service delivery, the delivery charge will neither be voided nor refunded.

Price and Payment

You understand that use of the Services will result in charges to you. FamilyFriend will enable your payment of the applicable Charges for services obtained through your use of the Services. Charges will include applicable taxes where required by law. Charges may include other applicable fees, cancellation fees, estimated or actual tolls, and/or surcharges. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand or due to other marketplace factors.

All Charges and payments will be enabled by FamilyFriend using the preferred payment method designated in your Account, after which you will receive a receipt. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that FamilyFriend may use a secondary payment method in your Account, if available. Charges paid by you are final and non-refundable, unless otherwise determined by FamilyFriend.

As between you and FamilyFriend, FamilyFriend reserves the right to establish or adjust Charges for any or all services or goods obtained through the use of the Services at any time. FamilyFriend will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. Certain users may from time to time receive promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you. Promotional offers and discounts are subject to change or withdrawal at any time and without notice. You may elect to cancel your request for Services at any time prior to the commencement of such Services, in which case you may be charged a cancellation fee on a Third Party Provider’s behalf.

With respect to Third Party Providers, Charges you incur will be owed directly to Third Party Providers, and FamilyFriend will collect payment of those charges from you, on the Third Party Provider’s behalf as their limited payment collection agent, and payment of the Charges shall be considered the same as payment made directly by you to the Third Party Provider. In such cases, you retain the right to request lower Charges from a Third Party Provider for services or goods received by you from such Third Party Provider at the time you receive such services or goods, and Charges you incur will be owed to the Third Party Provider. FamilyFriend will consider in good faith any request from a Third Party Provider to modify the Charges for a particular service or good. This payment structure is intended to fully compensate a Third Party Provider, if applicable, for the services or goods obtained in connection with your use of the Services. Except for amounts provided by you through the Application as part of the “tip” feature, FamilyFriend does not designate any portion of your payment as a tip or gratuity to a Third Party Provider. You understand and agree that, while you are free to provide additional payment as a gratuity to any Third Party Provider who provides you with services or goods obtained through the Service, you are under no obligation to do so. There also may be certain Charges you incur that will be owed and paid directly to FamilyFriend or its affiliates. For the avoidance of doubt, FamilyFriend does not charge a fee for a user to access the FamilyFriend Marketplace Platform, but retains the right to charge users a fee or any other Charge for accessing Services made available through the Marketplace Platform. Even if not indicated on the FamilyFriend Marketplace Platform, you understand that the prices for product or menu items displayed through the Services may differ from the prices offered or published by Third Party Providers for the same product or menu items and/or from prices available at other third party websites/mobile applications. Prices for product or menu items displayed through the Services may not be the lowest prices at which the product or menu items are sold.

If you think a correction should be made to any Charge you incurred, you must let FamilyFriend know in writing within 30 days after the Charge took place or FamilyFriend will have no further responsibility and you waive your right to later dispute the amounts charged.

Initially, payment for all services must be made by cash on delivery. Later, we will add the options of jazzcash, easypaisa and careem wallet.

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default.

If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Each of us agrees that the only rights and remedies available to us arising out of or in connection with a Representation shall be for breach of contract as provided in these terms and conditions.

Our right to vary these terms and conditions

We have the right to revise and amend these terms and conditions from time to time. You will be subject to the policies and terms and conditions in force at the time that you request services from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority or if we notify you of the change to those policies or these terms and conditions before we send you the Confirmation
